Probate
Probate is the legal process of validating a deceased person’s will and authorising an executor to administer the estate. In NSW, probate is often required to access assets like property, bank accounts, and superannuation.
Letters of Administration
Letters of Administration is a legal document issued by the NSW Supreme Court that grants someone (the “administrator”) the authority to manage and distribute the estate of a deceased person who has not left a valid will (intestate).
Under the Succession Act 2006 (NSW), eligible individuals can make a family provision claim if they feel they have not been adequately provided for in a will. These claims allow the NSW Supreme Court to redistribute the deceased’s estate to ensure fair provision for dependents and family members.
Will challenges
A legally binding will ensures that your wishes are respected and your loved ones are cared for after you’re gone.
Estate Administration
Estate administration is the process of managing and distributing a deceased person’s assets in accordance with their will or the intestacy laws of NSW (if there is no will). This involves tasks such as obtaining probate, paying debts, and ensuring beneficiaries receive their entitlements.
Estate Disputes
An estate dispute occurs when there is a disagreement over the administration or distribution of a deceased person’s estate.
Cross Border Disputes
A cross-border estate dispute arises when a deceased person’s estate involves assets, beneficiaries, or legal matters across different countries.
Cross Border Probate
Cross-border probate refers to the legal process of administering an estate that spans multiple countries.
Trust
A trust is a legal arrangement where one person (the trustee) holds and manages assets for the benefit of another (the beneficiary). Trusts can be created during your lifetime or as part of your will to take effect after your death.
Enduring Power of Attorney
A Power of Attorney gives another person (your “attorney”) the authority to act on your behalf for financial and legal matters. This can include managing bank accounts, selling property, and handling investments.
Appointment of Enduring Guardian
An enduring guardian is someone you legally appoint to make personal, health, and lifestyle decisions on your behalf if you lose the capacity to make those decisions yourself.
Business Succession Planning
Business succession planning is the process of preparing for the transfer of ownership, management, or control of your business. A well-structured plan ensures the business remains stable and successful during transitions, whether due to retirement, illness, or unforeseen events.
Elder Law (Nursing home contracts)
A nursing home contract is a legal agreement between a resident (or their representative) and an aged care facility. These contracts outline the rights, responsibilities, and financial obligations of both parties.
